PRESALE TERMS

These Presale Terms and Conditions (these “Presale Terms”) govern the placing of presale orders (“Presale Order”) with Big Think, Inc. (“Big Think Edge”), for your subscription to the Big Think Edge streaming video services (“Services”). Please read these Presale Terms carefully before submitting your Presale Order. By submitting your Presale Order, you agree to be legally bound by these Presale Terms.

Registration:

When placing a Presale Order for your Services, you will be required to provide certain information, such as your email address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Big Think Edge shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact information. You can update your information by sending an e-mail to [email protected].

Payment:

You will be charged at the time of placing a Presale Order. Your placing of a Presale Order constitutes your express agreement to Big Think Edge charging of your provided payment method at such time.

Cancellation:

You or Big Think Edge may cancel your Presale Order at any time for any or no reason prior to the launch of the Services. If you or Big Think Edge cancels your Presale Order prior to launch, you will obtain a refund of the purchase price without interest.

Services Launch:

The Services are expected to launch on March 30, 2019, subject to reasonable delays. Such date is only an estimate, is subject to change, and Big Think Edge does not represent or warrant that it will be able to launch the Services by the estimated date. As a result, in the event that a delay arises and the estimated launch of the Services is not met, Big Think Edge is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Presale Terms, to provide any discounts, refunds or credits due to any such delays.

Terms of Use and Privacy Policy:

The purchase of the Services is subject to the Big Think Edge Terms of Use. Big Think Edge will use any information that we collect about you in accordance with the Big Think Edge Privacy Policy.

LIMITATION OF LIABILITY:

UNDER NO CIRCUMSTANCES WILL BIG THINK EDGE BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT. IN THE EVENT BIG THINK EDGE IS HELD LIABLE FOR ANY DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE THE FULL REFUND OF YOUR PURCHASE PRICE WITHOUT INTEREST.

Changes to the Terms:

Big Think Edge reserves the right to change any of the Presale Terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your reservation as described above.

General:

These Presale Terms, together with the Terms of Use, Privacy Policy, and any other agreements expressly incorporated by reference into these Presale Terms, are the entire and exclusive understanding and agreement between you and regarding your Presale Order and the other matters described in these Presale Terms. These Presale Terms will be governed by the laws of the State of New York without regard to its conflict of law provisions.
